The Battle of Buenas on 32nd: A Legal Showdown Over Air Conditioning
Recently, the Buenas on 32nd apartment complex found itself in the midst of a legal battle as the Attorney General’s Office filed a lawsuit against them. The issue at hand? Tenants were facing problems with their air conditioning units, leading to a heated courtroom confrontation between state prosecutors, defense attorneys, and a judge.
During the court proceedings, both sides could not come to an agreement on the actual temperature inside the apartments. To settle the dispute, Judge Frank Moskowitz ordered a temperature test in five different units. However, conflicting readings only added to the tension in the courtroom.
Denise Holliday, representing the apartment complex, explained that in one of the units, the resident found the temperature to be too cold, contrary to the required 82-degree mark set by Phoenix City Code. Prosecutors argued otherwise, stating that their readings showed the temperature exceeding the legal limit.
To resolve the issue once and for all, Judge Moskowitz mandated a retest of the units, this time with both parties standing in the room for an hour to monitor the air conditioning system. The outcome of this latest round of tests is still pending.
