TUCSON, Arizona – After a two-week trial, Jana Giron has been found guilty of tampering with physical evidence in the case involving the deaths of Paul Garcia and Caitlin Festerling in 2019.
The tragic incident took place near Shannon and Lambert Road, where Giron was accused of causing the fatal crash. The prosecution’s case was bolstered by evidence from Giron’s phone, which showed that text messages to another parent from her child’s soccer team had mysteriously disappeared. Giron claimed that the texts had been sent before she left home and she was unaware of why they were missing from her phone.
The fateful day of the crash, November 13, 2019, saw Festerling and Garcia driving near Shannon Road and Sahuaro Divide when Giron allegedly rear-ended their vehicle, sending it into oncoming traffic where it was struck head-on by a truck. The devastating collision claimed the lives of both Festerling and Garcia.
While Giron was found guilty of tampering with physical evidence, the jury could not reach a verdict on the charges of manslaughter and negligent homicide in the case.
Pima County Attorney Laura Conover announced on Friday that prosecutors will be seeking a new trial to pursue justice for the victims, Festerling and Garcia.
