Broadcasters like 12News must accept political ads from candidates, regardless of their content, as mandated by the Federal Communications Commission (FCC).
Why Are Controversial Ads Aired?
Under FCC regulations, failing to allow a legally qualified candidate to purchase ad space can result in the revocation of a station’s license. In addition, broadcasters are prohibited from charging more for political ads, ensuring fair and equal access to airtime for candidates.
“The law is clear that any qualified candidate has the right to air an ad, regardless of its content,” explained Gregg Leslie, ASU professor and executive director of the First Amendment Clinic.
The FCC oversees communications across the country, ensuring that all media outlets adhere to the guidelines set forth in America’s communication laws.
